BANKRUPTCY LAW MATTERS
Bankruptcy matters are handled by the Firm on an hourly rate per hour basis. Based on a free case evaluation the client receives an estimate of the legal fees involved to complete the case.
Basic Chapter 7 and 13 cases filed for individuals or spouses' with a joint petition usually involve debtors with W-2 wages, although self-employed or independent contractors with (1099) income generally fall into the basic case profile. Chapter 7 cases generally display routine household assets that are often exempt from Trustee action. Case liabilities are usually medical bills, credit card debt, and leases. Chapter 13 cases often involve property repossession and foreclosure issues. As part of the Firm's free initial conference and review of the client's financial information, the Firm provides the following estimated range of fees for basic chapter 7 and 13 cases:
$700- $1050 FOR CHAPTER 7 CASES
$2000- $3500 FOR CHAPTER 13 CASES.
These are fee estimates based on the Firm's experience handling basic bankruptcy cases. These are NOT " FLAT FEE" quotes. The actual amount of legal fees will be based on the attorney's billing rate and the time required to complete the legal work agreed upon by the Firm and the client.
The Firm's bankruptcy reorganization cases such as Chapter 13 ( more complex than basic version), Chapter 11, or Subchapter V involve more complex legal issues, extensive fact-finding, and analysis. For these types of cases, along with collateral matters that may arise, such as adversary proceedings, relief from stay motions and hearings, 2004 examinations, and other contested matters, the Firm will charge a reasonable hourly rate. Based on the client's financial information and case circumstances, the Firm will provide an estimated range of fees to complete these types of cases.
WILLS & TRUSTS & BUSINESS LAW MATTERS
All estate planning and business law related matters are handled on a " rate per hour" basis. The Firm provides each client with a written Fee Agreement setting out the Firm's fee structure, the type of legal professional assigned to the matter, the scope of the legal work to be performed, and specific exclusions, if any, that may be associated with the case. In addition, the firm provides the client with an estimate of the attorney and paralegal time by major work category to complete the case.
